1. RUKA TREK COMMERCIAL TERMS AND CONDITIONS

The following terms and conditions apply to products and services offered and brokered by Ruka Trek Team Oy (hereinafter referred to as RT).

1§ Prices

The prices stated in the price list include value added tax in accordance with the Value Added Tax Act (1501/1993).

The prices and contents of the products and services offered by RT are defined in product and/or service-specific descriptions either in written offers or in the online store shop.rukatrek.fi and/or on the website www.rukatrek.fi. RT reserves the right to adjust prices, for example if the value added tax rate changes or based on other external factors.

2§ Reservation and confirmation of reservation

A reservation received by RT is considered confirmed by accepting a purchase made in the online store or by responding to a reservation request or order received by email.

3§ Cancellation terms and fees for accommodation, catering and activity programme services

• cancellation 21-14 days before the booking date: refund fee of 50% of the booking price

• cancellation 13-1 days before the booking date and non-cancelled bookings: payment of 100% of the booking price, payment is non-refundable

If cancellation occurs 22 days or earlier, an office fee of €45 per booking will be charged.

4§ Cancellation terms and fees for rental products

• cancellation 14-7 days or earlier before the start of the rental: payment of 50% of the booking price

• cancellation 6-1 days before the start of the rental and non-cancelled bookings: payment of 100% of the booking price

 

If cancellation of rental products occurs 15 days or earlier, cancellation is free of charge.

Late arrivals

RT reserves the right to cancel a confirmed reservation in situations where the customer or the participants in the order made by the booker are late for the agreed service start time. If the reservation must be canceled due to lateness, the cancellation fee is 100% of the price stated in the order confirmation and the payment is non-refundable.

6§ Changes

All requests for changes and corrections to reservations must be made in writing by email to sales@rukatrek.fi. Requested changes require written approval from RT.

7§ Children

If a child price is mentioned in the services or products, it is valid for 4-12 year olds. On a snowmobile safari: The child price entitles you to a seat in a sleigh pulled by a guide snowmobile. When paying the adult price (height limit 140 cm), the child can sit as a passenger in the snowmobile. Snowshoe and ski tours can be physically demanding and are not recommended for children under 12 years of age.

We do not recommend snowmobile safaris for children under 4 years of age. RT reserves the right to refuse participation to young children for safety reasons (e.g. due to challenging weather or trail conditions).

Our programs, such as snowshoe, cycling, skiing, snowmobiling, husky and reindeer tours, can be physically demanding and participants may be exposed to physical exertion, vibration or carbon monoxide (when snowmobiling). Husky, reindeer and snowmobile tours are not recommended for pregnant women.

General Terms and Conditions

The attached general terms and conditions apply to all provisions of these commercial terms and conditions mentioned above.

2. RUKA TREK GENERAL TERMS AND CONDITIONS

Definitions

“RT” abbreviation refers to the company: Ruka Trek Team Oy

“Customer” is a person to whom the services or products provided by RT’s order confirmation apply.

“Agent” is a person/travel agent who places an order with RT.

hereinafter RT, consumer and agent are also referred to individually as “party” and collectively as “parties”.

“Order” is a purchase or any request from a customer or agent to RT to make a reservation and specify the ordered services.

“Order confirmation” is any written document from RT to the customer or agent that contains price information and confirmation of the availability of the ordered services.

“Effective date” refers to the date on which RT has delivered the order confirmation or otherwise accepted the order or, at the latest, the date of receipt of the first payment installment related to the order.

“Commercial Terms” means RT’s terms and conditions of service, which include terms and conditions on payment, price, order changes and cancellation fees, among others.

“Services” means the services provided by RT in accordance with the order confirmation, which may include, for example (non-exhaustive list) accommodation and program services, meal and separate dinner services, husky, reindeer or snowmobile rides. RT is entitled to decide on the level of services.

“Products” means the products sold by RT in accordance with the order confirmation, which may include, for example (non-exhaustive list) rental electric bicycles, snowmobiles, snowshoes and winter equipment. RT is entitled to decide on the content and quantity of the products sold.

The “Agreement” between the parties consists of these general terms and conditions and commercial terms and conditions from the effective date, regarding the order confirmation and the services confirmed therein. All written changes agreed upon by the parties shall be binding in their entirety.

Confirmation

The order is considered confirmed when RT delivers the order confirmation to the customer or agent. RT reserves the right to cancel the order in situations where RT has not received payment by the agreed due date. The cancellation fee terms are in the commercial terms.

3§ Payment

Payments must be made in euros (EUR) before the service is delivered or according to the agreement (invoiced customers).

Failure to make payment on time constitutes an essential breach of contract and RT has the right to immediately, without a separate notice period, stop providing the services or renting the products for the unpaid parts.

4§ Cancellation terms

The agent and customer have the right to cancel the services in whole or in part. The customer or agent must notify RT of the cancellation of the services in writing without undue delay. The cancellation fee terms are mentioned in the commercial terms.

5§ Customer obligations

The customer and/or agent undertakes to fulfill their contractual obligations and to provide the requested information carefully so that RT is able to fulfill its own obligations properly and within the agreed schedule.

6§ Responsibilities, insurance, consumer information obligations, compensation, animals, etc.

RT shall comply with preventive, planned, diligent and appropriate health and safety measures in accordance with Finnish legislation and recommended practices when providing the program services under this agreement.

7§ Language of service

The language used in the services and guidance during the services is Finnish or English, unless otherwise stated or agreed.

8§ Liability insurance

RT has general liability insurance.

9§ Traffic liability insurance

All motorized transport vehicles that are roadworthy in Finland must have valid traffic liability insurance. Compensation for damages and injuries resulting from a traffic accident is covered by the valid traffic liability insurance of the vehicle that caused the accident, taking into account what is stated below.

According to Finnish law and the provisions of the terms and conditions of the traffic liability insurance, any person who has suffered bodily injuries is entitled to compensation for medical expenses, pain and suffering and permanent disability. The compensation levels are determined by Finnish law and official regulations. However, if the injuries of a party are a result of his own intentional or grossly negligent actions, the injured party is not entitled to compensation for damages.

10§ Snowmobiles used on guided safaris

All snowmobiles used and rented on RT safaris are covered by traffic liability insurance in accordance with Finnish law. The terms and conditions of the above-mentioned traffic liability insurance and Finnish law apply to the coverage of the insurance. The above-mentioned terms and conditions also apply in other respects.

Customers participating in safaris are responsible for any damage they cause to their snowmobiles. In the event of an accident, the maximum personal deductible self-liability per snowmobile is €1.500. The agent must always notify RT in writing if each customer signs a personal deductible or if one person in the customer group signs this on behalf of the entire customer group.

The snowmobile driver must be at least 18 years old and have a valid driver's license approved in Finland. The snowmobile driver must be able to present his/her driver's license during the safari, as the police or boarder guard may check the validity of the driver's license during the safari. Finnish law prohibits driving a snowmobile under the influence of alcohol or drugs. As a responsible safari organizer, RT reserves the right to change routes, schedules and duration of trips if the prevailing weather conditions so require or if it is necessary for safety reasons and the comfort of the participants. RT also reserves the right to interrupt the safari if the participant is considered to be potentially dangerous to himself/herself or other participants or is in poor condition.

11§ Electric bicycles used on guided safaris

The electric bicycles used on RT's guided safaris are not registered for road traffic and are therefore not covered by motor vehicle insurance.

Customers participating in safaris are responsible for any damage they cause to the electric bicycles, to themselves or to third parties. The customer must always notify RT in writing if each customer signs a personal deductible or if one person in the customer group signs this on behalf of the entire customer group.

Finnish legislation prohibits riding a bicycle under the influence of alcohol or drugs. As a responsible safari organizer, RT reserves the right to change routes, schedules and duration of the tours if the prevailing weather conditions so require.ai if necessary for safety reasons and the comfort of the participants. RT also reserves the right to interrupt the safari if the participant is considered to be potentially dangerous to himself or other participants or is in poor condition.

12§ Other damages

RT can only be held liable for personal injury and property damage that has occurred during the provision of services under this agreement and is a result of the negligence of RT or its personnel or subcontractors or based on liability for defective equipment. RT is not liable for accidental damage or injuries that are covered by the customer's travel insurance. Taking out personal travel insurance is always highly recommended.

Activities, e.g. snowmobiling, bike safaris and snowshoe tours, can be physically demanding and participants may be exposed to various physical stresses. Therefore, the customer is obliged to inform RT before participating in safaris, excursions, activities and other programs or services included in the order confirmation if the consumer has a medical condition or limitation (for example, heart disease, asthma, diabetes, epilepsy or back or pelvic problems) that may affect his/her ability to participate in the program services or if he/she is pregnant. In these cases, the customer must consult a medical expert before participating in the services regarding his/her ability to participate in the services in question. The customer is obliged to inform all customers referred to in the order confirmation of their responsibility to assess their ability to participate in the services.

All insurance documents with their terms and conditions are available to the customer upon request.

13§ Animals

All animals used in the services (reindeer and husky rides) are trained to the extent possible for the activity in question. However, the behavior of the animals can never be fully predicted. For this reason and to reduce risks, safety and other instructions given must be followed.

14§ Error notification

An error that can be corrected during the service must be reported to RT without delay and as soon as possible during the service. After the service, the customer may not invoke the error unless he/her reports the error to RT within a reasonable time after he noticed the error or should have noticed it, but no later than 30 days after the end of the agreement or services.

15§ Price reductions and compensation

If RT has provided a materially incorrect service or delivery, RT is obliged to compensate the customer or agent for a maximum of the price paid by the customer or agent for the incorrect service.

16§ Prices

All prices stated are in euros and include value added tax (VAT) in accordance with the Finnish Value Added Tax Act. Marginal taxation and reverse charge liability for tour operators apply when required by the Value Added Tax Act. All prices are based on the requested period, group size, season, service type and availability, and other relevant factors taken into account in pricing. RT has the right to change the price of services at its discretion if there are changes in the content or basis of the services.

RT reserves the right to make changes to prices if there is a significant increase in the cost of supplies, currency or fuel or if a significant increase in prices is due to them, as well as in the event of a change in value-added tax (VAT) or other taxes.

RT reserves the right to apply promotional offers and booking benefits to new bookings. In this case, a new booking means a booking made during the validity period of the promotional offer or booking benefit. In addition, the rules and instructions of each campaign apply to promotional offers and booking benefits. Offers and benefits are personal and are not transferred to another passenger in the event of a name change and are not granted retrospectively. Promotional offers and booking benefits do not apply to group and special trips.

17§ Force Major

RT is not liable for any negligence, damage or loss resulting from a force major event or an unreasonable impairment of its operations in similar situations (for example, war, strike, lockout, impossible or dangerous weather conditions for the provision of services, such as lack of snow).

If a force major event is imminent, RT must immediately notify the other party in writing. RT must keep the other party informed of the continuation of the force major event and notify it of any significant changes in circumstances during the force major event. When a force major event is imminent, RT must also take all reasonable measures at its disposal to minimize the effects of the force major event on the fulfillment of its obligations under this agreement.

18§ Validity of the Agreement

This agreement enters into force from the date of entry into force and is valid until the date of termination, unless the agreement ends earlier due to termination. The date of termination is the last day of service delivery stated in the order confirmation.

19§ Content of the Agreement

As of the date of entry into force of the Agreement, this Agreement overrules all previous agreements, statements or commitments between the parties related to the order confirmation, whether oral or written. As of the date of entry into force, this Agreement, which consists of the order confirmation, these general terms and conditions, commercial terms and conditions and any other amendments mentioned in the order confirmation, forms the basis of the entire agreement between the parties with regard to the matters agreed therein.

20§ Communication

Notifications and other communication between the parties under the Agreement must be made in writing (e.g. e-mail) in Finnish or English.

21§ Suppliers and subcontractors

RT has the right to use suppliers or subcontractors in the provision of services.

22§ Applicable law and disputes

The agreement and any disputes related to it shall be governed by Finnish law. If a dispute concerning the agreement cannot be resolved through negotiations between the parties, the consumer may refer the matter to the Consumer Disputes Board (kuluttajariita.fi). Before referring the matter to the Consumer Disputes Board, the consumer must contact the Consumer Advice Service (kuluttajaneuvonta.fi). The passenger may also refer the dispute to the district court of the service provider's domicile.

If the agent is a business operator and the disputes cannot be resolved through negotiations between the parties, the disputes shall be resolved in the district court of the service provider's domicile.

23§ Sovereignty of Terms

If any part, condition or provision of this Agreement is held to be invalid, illegal or unenforceable in whole or in part, the remaining terms and conditions of this Agreement shall remain in full force and effect.

General rental and reservation terms and conditions for sports equipment, equipment and vehicles

The attached general reservation and rental terms and conditions shall apply to all provisions of these commercial and general terms and conditions mentioned above.

3. GENERAL RENTAL AND RESERVATION TERMS AND CONDITIONS FOR SPORTS EQUIPMENT, WINTER GEAR AND VEHICLES

1§ The customer must prove his/her identity. In connection with the rental, RT may request credit card details as a guarantee.

2§ The products are not necessarily new and may show signs of use. The customer must check the condition of the product before use. Defects and deficiencies may be noted in the rental agreement. RT recommends taking photographs of the rental product before the start of the rental.

3§ The customer undertakes to comply with applicable laws and regulations as well as good manners. The customer also undertakes to use the product only in the manner intended. The use of the products under the influence of alcohol or other intoxicating substances is prohibited.

4§ The customer may not hand over the product to a third party, unless otherwise agreed.

5§ It is prohibited to take the rented product outside the borders of Finland.

6§ The customer undertakes to take good care of the rented product. The customer is liable for the full purchase value of the rented product and equipment until they have been returned to RT. In the event of damage, the customer is obliged to report the damage and injury to RT immediately. The customer is obliged to compensate for any damage/injury to the products and equipment, return the products to RT and also report the damage to the staff.

7§ If the product has a technical defect or other similar error during the rental period and RT repairs or delivers a replacement product within a reasonable time, no compensation will be granted for the rent or loss of rental time.

8§ The customer is also liable for damage caused to third parties. RT is not directly or indirectly liable for damages caused to the customer or third parties due to possible product breakage.

9§ The product must be returned to the agreed location before the end of the agreed rental period. If the customer does not return the product to the agreed location within the agreed time, the owner has the right to charge double the fee for the excess time and to charge the costs incurred due to negligence.

10§ RT has the right to terminate this agreement before the end of the rental period if it becomes apparent that the customer does not comply with the rental terms of the rental agreement. In this case, RT will not compensate for the lost rental time.

4. SPECIAL RENTAL TERMS AND CONDITIONS FOR ELECTRIC-ASSISTED BICYCLES

1§ RT's electric-assisted bicycle rental terms and conditions and regulations are defined in RT's commercial, general and these rental terms and conditions, the rental agreement and Finnish legislation. By signing the rental agreement, you agree to comply with these special rental terms and conditions.

2§ The rented electric bikes and their accessories are the property of RT.

3§ The accessories are a lock and a helmet.

4§ If the customer hands over the bike to a third party, the renter is also fully responsible for any damage to the bike.

5§ The electric bike may not be taken outside the borders of Finland.

6§ Payment of the rental: The rental price is paid in advance via RT's booking website, unless otherwise agreed. Any additional hours are paid upon return.

7§ The rental period always ends at 17:00 at the latest, unless otherwise agreed.

8§ The customer's identity is always checked upon rental with a valid photo ID (passport, EU driving license or ID card).

9§ A person under the age of 18 can rent an electric bike accompanied by their guardian.

10§ When signing the rental agreement, the customer is responsible for all damage and loss that occurs to the electric bicycle and accessories during the rental. The customer is obliged to compensate for any damage to the electric bicycle or accessories at their actual value and repair cost whenever the damage is caused by the customer himself. The bicycles are insured against theft, natural phenomena or fire. In this case, the customer is responsible for their deductible self-liability of 500€. By signing, the customer confirms that he is fully aware of these rental terms and conditions.

If, for example, the bicycle tire punctures, the rider must stop riding immediately and notify RT. The bicycle must be carefully moved to at least a road, within a maximum radius of 10 km from RT. For example, the price of repairing a punctured tire is 60€, including the transportation of the broken bicycle by car on the road within a maximum radius of 10 km from RT.

11§ If the electric bicycle is returned after the agreed deadline, the customer will pay an additional fee according to the price list. If the customer returns the bike before the agreed deadline, he will not receive compensation for the unused time.

12§ The customer declares that he/she is committed to taking care of the electric bike so that the bike is always locked with a lock when the electric bike is unattended and all removable accessories are with the customer. The electric bike must be locked with a lock preferably to a fixed object, such as a post, bike rack, railing, etc. The customer must not leave the electric bike unattended for an unreasonably long time.

13§ In the event of theft or a traffic accident, the customer must immediately contact the general emergency number 112 to report it, and also immediately contact RT at +358 41 315 9758.

14§ The customer declares that he/she understands that he has no right to claim compensation from RT in the event of personal or property damage when the electric bike is rented to the customer.

15§ The customer is fully responsible for all damage that occurs when the electric bike is rented to him/her until it has been returned to RT and found to be in perfect condition. Damages are subject to the conditions in force in accordance with these terms and conditions.

16§ RT is responsible for the good technical condition of the electric bike and guarantees that the electric bike has been regularly maintained.

17§ RT reserves the right not to rent an electric bike without explanation if the customer does not seem trustworthy, appears unable to ride an electric bike or take care of the electric bike safely.

18§ The customer must understand that cycling always involves its own risks and when using RT's services, the customer does so entirely at his own risk.

19§ The customer must use the bicycle helmet provided as an accessory in accordance with Section 90 of the Finnish Road Traffic Act.

5. SPECIAL RENTAL TERMS AND CONDITIONS FOR SNOWMOBILES

1§ RT's snowmobile rental and reservation terms and conditions are defined in RT's commercial, general and these rental terms and conditions, the rental agreement and Finnish legislation. By signing the rental agreement, the customer agrees to comply with these rental terms and conditions. The driver agrees to comply with Finnish law and regulations and good manners.

2§ The snowmobile may not be used in competitions, or in illegal activities, or driven on roads or streets. The transfer of the snowmobile or its export abroad is prohibited without the permission of RT. Off-road driving is only permitted on marked snowmobile tracks or routes. The speed limit for snowmobiles on off-road is 60 km/h and on ice 80 km/h. RT has the right to terminate the agreement during the rental period if it becomes apparent that the renter is in material breach of this agreement or that the renter is unable to handle the vehicle properly, in RT's opinion. In such cases, the rental fee will not be refunded.

3§ The minimum age for renting a snowmobile is 18 years and the driver's driving license category is at least T. It is prohibited to drive a snowmobile under the influence of alcohol or other intoxicating substances. The minimum height of a snowmobile passenger is 140 cm.

4§ The rental includes 150 kilometers/day, excess kilometers are charged at 2€/km, unless otherwise agreed.

5§ The rental price does not include fuel. The snowmobile is rented with a full tank and is to be refueled by the customer at a nearby gas station. 98E fuel must be used when refueling the snowmobile. The snowmobile can also be returned with a low tank, in which case the fuel used and a refueling fee of €30 will be charged.

6§ During the rental period, the customer is obliged to take care of the normal checks of the snowmobile before starting the ride.

7§ The customer is responsible for any damage caused to the snowmobile and third parties.

8§ Any breakage or damage to the snowmobile must be reported immediately to RT. Repair work may not be carried out without RT's permission. If the snowmobile has a technical fault or other error during the rental period and RT has it repaired or a replacement snowmobile delivered within a reasonable time, no refund will be given for the rental or for the loss of rental time.

If RT picks up the snowmobile off-road due to a drive-off from the route or other damage caused by operating errors, the customer will be charged a collection fee of €500.

9§ At the start of the rental, the customer must check the condition of the snowmobile and report any defects or deficiencies.

10§ The snowmobile must be returned to RT at the agreed time. Any excess rental time will be charged at the hourly rental rate / starting hour / snowmobile according to the rental price list.

11§ In case of problems, we offer telephone advice. Unless it is a technical fault, assistance provided off-road will be charged at least €50, depending on the distance to the event location.

12§ The snowmobile has valid motor vehicle insurance. The customer's deductible self-liability in the event of damage or due to driving errors is a maximum of €1.500. In the case of snowmobile damages the deductible self-liability must be paid to RT immediately after the rental ends.
